Terms of Use

These Terms of Use govern your access to and use of lms.gamexvibes.com and all related services operated by Initbod Limited ("we", "us", "our"). By accessing or using GameXVibes Academy, you agree to be bound by these Terms.

1. Eligibility

GameXVibes Academy may be used by:

• Students of any age, with parental consent required for those under 18
• Lecturers and educators who have completed self-registration
• Institutions (universities, schools, colleges) with a registered account
• Parents and guardians accessing the Parent Portal

2. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your access credentials (Student ID, Parent Access Key, Lecturer Key). You agree to notify us immediately of any unauthorised use of your account at support@gamexvibes.com.

3. Acceptable Use

You agree not to:

• Use the platform for any unlawful, harmful, or fraudulent purpose
• Attempt to reverse-engineer, scrape, or extract platform data or AI models
• Share your account credentials with others or allow unauthorised access
• Upload content that is obscene, defamatory, or infringes third-party rights
• Interfere with or disrupt the platform's servers, infrastructure, or security
• Impersonate another person, institution, or lecturer
• Use the platform to distribute spam, malware, or unsolicited communications

4. Lecturer Content & Revenue Sharing

Lecturers who create and publish courses on GameXVibes Academy:

• Retain ownership of their original course content
• Grant GameXVibes a non-exclusive licence to host, display, and deliver their content to enrolled students
• Are entitled to a 70% revenue share on course sales, subject to our Revenue Sharing Policy
• Are responsible for ensuring their content is accurate, original, and does not infringe third-party intellectual property
• Consent to their uploaded portrait and voice sample being used solely for generating their AI teaching avatar on the platform

5. Subscriptions & Payments

Paid subscriptions are billed in advance (monthly or annually) via Flutterwave. Subscription fees are non-refundable except where required by applicable law or within our 7-day satisfaction guarantee window. To request a refund, contact support@gamexvibes.com within 7 days of payment.

We reserve the right to modify pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

6. Intellectual Property

All platform technology, AI systems, design, branding, and non-lecturer content is the intellectual property of Initbod Limited and may not be reproduced, distributed, or used without express written permission. The GameXVibes name, logo, and distinctive visual identity are trademarks of Initbod Limited.

7. AI-Generated Content

Lesson scripts, assessments, and responses generated by the AI tutor are provided for educational purposes only. We do not guarantee the accuracy of AI-generated content and encourage learners to verify information with qualified educators. GameXVibes is a research-stage platform and AI outputs represent hypotheses under evaluation.

8. Platform Availability

We aim for high availability but do not guarantee uninterrupted service. We may conduct maintenance, updates, or experience downtime. We are not liable for losses resulting from service interruptions beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Initbod Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability in any circumstances shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria. For users in the EU or UK, mandatory statutory rights under local law are unaffected.

12. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice, at our sole discretion. You may close your account at any time by contacting us. Upon termination, your access to the platform will cease and your data will be handled per our Privacy Policy.
